New Amendments to Regulations on the Environmental Impact Assessment System Are Approved

On December 31, 2025, the Comptroller General of the Republic confirmed Supreme Decree No. 17/2025, which amends the Regulations of the Environmental Impact Assessment System (the “Regulations”) in order to update the criteria for entry due to project or activity modifications and certain thresholds in the list of typologies established therein. Its publication in the Official Gazette is now the only step pending.

The main amendments introduced by the Regulations include the following:

Adjustment of entry criteria for project modifications.
The obligation to submit parts, works, or actions intended to intervene or complement an already approved project or activity to the Environmental Impact Assessment System (“SEIA”) is eliminated when such elements constitute a project or activity listed in Article 3 of the Regulations under the same typology for which the original project was assessed. In such cases, a “change of consideration” will only be deemed to exist if any of the other scenarios regulated in that provision are met.

Update of typologies and entry thresholds to the SEIA.
Entry thresholds are increased for, among others, electric transmission lines, service stations, aquaculture projects, hazardous substances and sanitary services, with the aim of reducing the submission of smaller-scale projects that do not entail significant environmental impacts. In addition, certain technical criteria are clarified, definitions are incorporated, and specific exceptions are introduced for mining projects, among other adjustments.

Modification of minimum content requirements for Environmental Approval Resolutions.
A new requirement is introduced to expressly identify the applicable project or activity typologies, as well as those corresponding to its parts, works or actions, in accordance with Article 3 of the Regulations.
