New Sectorial Permits Framework Law

On September 29, 2025, Law No. 21,770, the Sectorial Permits Framework Law (“LMAS”), was published in the Official Gazette. This law establishes a general framework for State Administration bodies with authority to enable projects or activities subject to regulatory limitations.

Its purpose is to provide greater certainty to project owners and promote productivity, growth, and investment through modernization mechanisms and a progressive transition towards standardized and simplified regulation.

Key highlights:

  • Alternative Enabling Techniques: As a general rule, projects or regulatory activities shall be enabled through notices and sworn statements, which will have the same legal effects as permits.
  • Standardized Procedure: Minimum rules are established for administrative procedures, including mandatory maximum timeframes for the Administration, with the aim of reducing processing times.
  • Administrative Silence: Applicants may invoke administrative silence when the Administration fails to resolve within the legal timeframe. The Unified Information System for Sectoral Permits will automatically issue a certificate upon request.
  • Regulatory Stability Regime: A stability regime is created for projects subject to the Environmental Impact Assessment System with a favorable Environmental Approval Resolution, allowing sectoral authorizations and enabling techniques to remain under the regulations in force at the date of submission of the Environmental Impact Declaration or Study, for up to 8 years.
  • Amendment of Legal Frameworks: Various sectoral statutes are amended to incorporate new powers, use of alternative enabling techniques, mandatory timeframes, and elimination of certain authorizations.

The LMAS entered into force on September 29, 2025, although many of its provisions will depend on implementing regulations.
