Ministry of the Environment Requests Information from Producers of Priority Products under EPR Law

On July 15, 2025, the Chilean Ministry of the Environment (MMA) issued Exempt Resolution No. 4,771, requiring producers of certain priority products to report the quantities introduced into the national market during 2024, expressed in units, cubic meters and/or ton, as applicable.

This obligation falls under the Extended Producer Responsibility (EPR) Law No. 20,920 and forms part of the MMA’s oversight processes.

The requirement applies to producers of lubricating oils, electrical and electronic equipment, batteries, small batteries, newspapers and magazines, bicycle and wheelchair tires, textiles (on a voluntary basis), and certain producers of containers and packaging —such as those who introduced less than 300 kg into the market, used reusable containers, or whose containers classified  under the “other” category, provided they are not classified as microenterprises under Law No. 20,416.

In the case of reusable containers, the information must also include data on the tons that: (i) were acquired (insofar as they are new); (ii) became waste in the possession of the producer; and (iii) were used to market packaged goods, distinguishing how many correspond to new containers and how many recovered after at least one use.

Declarations must be submitted no later than September 15, 2025, through the REP-Producer sectoral system available at the Single Window of the Pollutant Release and Transfer Register (https://portalvu.mma.gob.cl/).

Producers affiliated with a management system associated with priority products, such as tires and/or containers and packaging, must comply with the requirement through said system, but only with respect to categories and subcategories of the priority product that are not subject to targets or extended producer responsibility. The MMA will timely inform the channel through which the corresponding declaration must be submitted.
