Public consultation period extended for EPR battery regulation
Public consultation period extended for the draft regulation setting collection and valorization targets for batteries
On April 9, 2026, through Exempt Resolution No. 1,824/2026, the Ministry of the Environment extended by 15 business days the public consultation period for the draft supreme decree establishing collection and recovery targets for batteries, along with other associated obligations, which had been previously approved by Exempt Resolution No. 821/2026.
Accordingly, the new deadline for the public consultation process is April 30, 2026.
In general terms, the draft regulation proposes incorporating batteries weighing five kilograms or more into the Extended Producer Responsibility (EPR) regime, classifying them as lead-acid batteries, lithium-ion batteries, and other batteries. It also establishes progressive collection and valorization obligations for their producers, to be fulfilled through authorized Management Systems.
Comments on the draft regulation may be submitted through the Ministry of the Environment’s citizen consultation platform. The full text of the draft regulation is available on the Ministry’s circular economy website.
