On October 1, 2025, Law No. 21,771 (“new law”) was published in the Official Gazette, amending the Organic Constitutional Law of the Public Prosecutor’s Office to address the growing complexity of organized crime and high-complexity offenses.
The law creates the Supraterritorial Prosecutor’s Office, based in Santiago with nationwide jurisdiction, headed by a Chief Prosecutor appointed directly by the National Prosecutor, aimed at enhancing the Public Prosecutor’s investigative capacity to tackle suprarregional and transnational criminal organizations.
The law also establishes the Criminal Analysis System for Organized Crime and High-Complexity Offenses, designed to improve criminal prosecution through data analysis, reporting, and the standardization of investigative procedures.
Additionally, both the Public Prosecutor’s Office and the defense may request that the Plenary of the Supreme Court transfer jurisdiction over cases under the Supraterritorial Prosecutor’s Office to the Guarantee and Oral Criminal Courts of the Santiago Court of Appeals, in order to centralize complex investigations while safeguarding the accused’s right to defense.
The law will take effect in April 2026, and its first Chief Prosecutor will be Miguel Orellana, currently Head of the High-Complexity and Organized Crime Prosecutor’s Office of the East Regional Prosecutor’s Office.
