On June 10, 2019, Exempt Resolution N° 544 of the Ministry of the Environment was published in the Official Gazette, which approves and submits to public consultation the preliminary draft decree that will establish collection and valorization goals and obligations associated with containers and packaging, in the context of Law 20,920 on Extended Producer Responsibility (“Law N° 20,920”).
Regulated containers and packaging
According to the preliminary draft, containers and packaging shall be considered as products of any nature and made of any material used to contain, protect, handle, facilitate the delivery, store, preserve, transport or improve goods presentation.
Collection and valorization goals
The preliminary draft establishes collection and valorization goals to be met by producers, on a progressive scale per year, considering two categories of containers and packaging:

Obligations associated to containers and packaging
The preliminary draft also establishes a series of additional obligations for producers of containers and packaging, in order to comply with the aforementioned collection and valorization goals, such as:
- Provide information regarding the fees of management systems and a list of producers involved in each system.
- Installation and operation of waste reception and storage facilities in boroughs with 40,00 and 119,999 inhabitants.
- Selective collection of household waste.
Accomplishment of collection and valorizations goals and obligations associated to containers and packaging
Producers of containers and packaging shall comply with goals and obligations through management systems established by Law N° 20,920, which shall constitute a guarantee in order to ensure the compliance with such goals and obligations.
Public consultation
Any natural or legal person may pose observations on the content of the preliminary draft, until July 23, 2019. Observations must be justified with relevant background information.
