Danish investor gets funds for Chilean BESS project

Copenhagen Infrastructure Partners has enlisted five Latham & Watkins LLP offices and Carey in Santiago to secure a US$147 million project financing package for the development of a battery energy storage system (BESS) project in Chile.

The banks relied on White & Case LLP in New York for the deal.

Latin Lawyer understands that Guerrero Olivos advised the banks too, but could not confirm this before publishing.

The deal was announced on 1 October.

Approximately US$135 million of the financing package comprised senior debt.

Copenhagen Infrastructure Partners will use the funds to develop its Arena BESS project in Chile’s northern Antofagasta region.

Construction of the project commenced in the first quarter of this year and is expected to conclude in the first quarter of 2026.

Once operational, the project will be one of Chile’s largest standalone BESS projects, with a storage capacity of 220 megawatts.

According to Latin Lawyer’s news reporting, three financing deals relating to Chilean BESS projects have taken place since the start of this year, including this transaction. Last month, for example, a special purpose vehicle (SPV) owned by Latin American energy group AES Andes secured a US$435 million loan for a project in Antofagasta, three months after regional energy company Zelestra obtained a US$300 million facility for a development in the Tarapacá region.

In terms of counsel, Chilean outfits Claro & Cía and Garrigues (Chile) advised on two of these deals, whilst Latham and fellow international firms Norton Rose Fulbright, A&O Shearman, Clifford Chance LLP and Milbank each provided counsel on one.
