National Institute of Industrial Property sets collection values of documents and reduces transmittal fee (PCT)


Dating February 25, 2011, by means of Exempt Resolution No. 078, the National Institute of Industrial Property, set the collection values of the following documents that are given to owners, in 500 Chilean Pesos (USD 1,04 / € 0,75).

1. Titles and certificates of commercial brands, invention patents, industrial designs, industrial drawings, utility models, layout designs or topographies of integrated circuits, geographical indications and denominations of origin and other titles of protection and certificates of industrial property rights that the Law may establish.

2. Printed application form of commercial brands, invention patents, industrial designs, utility models, layout designs or topographies of integrated circuits, geographical indications and denominations of origin of marginal note and of brand renovations and other industrial property rights that the Law may establish.

3. Patent data sheet application form

Marginal note certificates of commercial brands, invention patents, industrial designs, industrial drawings, utility models, layout designs or topographies of integrated circuits, geographical indications and denominations of origin and other industrial property rights that the Law may establish.

5. Final Decision Certificates.

6. Other certifications.

The Resolution indicates that the certificates and titles issued by the Institute will have a validity of 60 days from its issue date.

Additionally, by means of this Resolution a value of 200 Chilean Pesos (USD 0,42 / € 0,30) is set for each legal-sized sheet of paper or smaller, of the photocopies that are handen to the owners.

Later, on March 16, through Exempt Resolution No. 101, and conforming to the spirit of the promotion of knowledge established in Law 19.880, which establishes the Basis of Administrative Procedures, the National Institute of Industrial Property, reduced the transmittal fee (PCT) by the reception of the international application, by the transmission of copies to the International Office and to the administrative department in charge of the international search and for the compliance with all the other tasks to be undertaken in relation to the request as Receiving Office. Said rate had been set originally on May 28, 2009, for the sum of USD 350 and was reduced through this Resolution, to USD 130. The new regulation indicates that this rate should be calculated and consecutively paid in Chilean Pesos, according to the exchange rate observed the day before the date of payment, considering to the information published in the daily news of the Central Bank of Chile.
