Mrs. Dittus is specialist in Intellectual Property Litigation. Her practice is focused in disputes, litigation and enforcement concerning intellectual property rights and copyright infringement. Also her experience comprehends advice and judicial representation of patent holders in cases based on patent infringement; the judicial representation of trademarks owners in civil and administrative disputes arising from the application of special legislations; the representation of trade dress holders via Unfair Competition Act; and the defense of authors and related rights owners against copyright violations.

REPRESENTATIVE EXPERIENCE

  • Evercrisp Evercrisp on filing an evidentiary preliminary injunction aimed to prepare a civil action for unfair competition based on anauthorized commercial use (trade dress) of a snack category product by a competitor.
  • Annco on the successful IP protection of the term Loft, through the filing of nullity actions and oppositions against trademarks registered in Chile by Tricot and Inversiones Heads Corp.
  • Important pharmaceutical companies on the protection of its industrial property rights for patent infringement.
  • A transnational publishing company on a case related to copyright infringement based on moral and economic rights.
  • An important international company in the food sector on judicial civil claims to obtain the protection of its trademarks and trade dress.
  • Important international companies in the food sector on the protection of its trademarks in the light of the enforcement of the new sanitary and advertising regulations.
